TERMS OF USE
The general ordering terms apply to purchases made from the order environment at https://trivupel.games (hereinafter referred to as the Website) by the buyer (hereinafter referred to as the Customer) and Trivupel OÜ (hereinafter referred to as Trivupel) for the ordering of goods (hereinafter referred to as Product or Products).
In addition to these terms, legal relationships arising from the purchase of products from the Trivupel online store are governed by the Law of Obligations Act (hereinafter referred to as LOA), the Consumer Protection Act (hereinafter referred to as CPA), and other applicable laws in the Republic of Estonia.
The online store reserves the right to make changes to the sales terms. Such changes will be reflected on the website.
ORDERING PROCEDURE FOR PRODUCTS
Add the desired products to the shopping cart and select the appropriate delivery method.
To place an order, click on the "Order" link in the shopping cart.
On the order page, fill in the required fields, choose the appropriate delivery method, check the accuracy of your selections, and submit your order by clicking the "Place Order" link. After that, you will be presented with payment options and can pay via bank link or transfer.
Please carefully fill in the fields on the data and order confirmation page, as the accuracy and correctness of the information provided will determine the prompt and smooth delivery of your purchased products and the resolution of any disputes or claims.
Orders placed in the online store are processed on working days (Mon−Fri 9:00−17:00). If the order is placed on Friday after 16:00, the order will be processed on the following Monday. This also applies to the "self-pickup" delivery option.
All product prices displayed in the online store include VAT.
The price of the ordered products will be increased by the delivery fee according to the delivery method chosen by the Customer.
Under the sales contract, the online store is obligated to deliver the existing Product to the Consumer and transfer ownership to the Consumer, while the Consumer is obligated to pay the amount indicated on the invoice and accept the Product.
The sales contract enters into force after the Consumer’s payment has been received in the online store’s bank account.
PRODUCT DELIVERY
After the sales contract enters into force, the online store will assemble the order and hand it over to the company's logistics partners for delivery to destinations, which may include Omniva parcel machines, Smartpost, DPD Pickup parcel machines, or Trivupel stores.
The Customer can select the delivery method during the order process, and the prices will be visible to the Customer during order completion.
Delivery Time for Products:
The product will be delivered to the Customer within the time specified in the online store. If the order includes products with a longer delivery time, all products will be delivered to the Customer in one package, considering the longest delivery time of the products in the package.
The online store is not responsible for any damages or delays in delivery caused by circumstances beyond the online store’s control or unforeseeable events.
Product Delivery Methods (Estonia)
For delivery via Omniva parcel machine, Smartpost, and DPD Pickup parcel machine, the order will arrive at the selected parcel machine within 1-5 working days, and the door code for the parcel will be sent via SMS to the mobile phone. The parcel will be held in the parcel machine for 7 calendar days from the time the door code is sent to your mobile phone. If the parcel is not collected within this period, the order will be canceled, and after receiving the returned goods, Trivupel will refund the amount paid to the Customer's bank account.
For delivery via DPD courier, the order will arrive at the selected destination within 3 working days. The courier will call in advance to agree on a more precise delivery time. If the recipient cannot be reached to arrange a delivery time, the parcel will be directed to a parcel machine, where it will be held for up to 7 calendar days.
Orders delivered to a Trivupel store will arrive within 3 working days. The Customer will receive a notification email when the order arrives at the store. The Customer can collect the order within 7 calendar days with a valid ID. If the Customer does not collect the order within 7 calendar days, the order will be canceled. After receiving the returned goods, Trivupel will refund the amount paid to the Customer's bank account.
Product Delivery Methods (Worldwide)
Regarding shipments on global scale, Trivupel is committed to selecting the most efficient and reliable shipping options available to ensure timely and secure delivery of products to customers worldwide. Understanding that international shipping can vary significantly in terms of cost, delivery time, and service quality, Trivupel carefully evaluates and partners with reputable global logistics providers. The company prioritizes delivery methods that offer tracking capabilities, ensuring that customers can monitor their shipments in real-time. Additionally, Trivupel considers factors such as customs processing, local delivery networks, and customer preferences to choose the most suitable shipping option for each destination. By doing so, Trivupel aims to provide a seamless and stress-free international shopping experience, ensuring that products reach customers in the best possible condition and within the expected timeframes, no matter where they are located.
CONSUMER’S RIGHT TO WITHDRAW FROM THE ORDER
After receiving the order, the Consumer has the right to withdraw from the contract made in the online store without giving a reason within 14 days. To do so, the Consumer must submit an unambiguous withdrawal statement in writing or by email to Trivupel or use the withdrawal form available [here](trivupel.games@gmail.com).
In the withdrawal statement, the Consumer must indicate the bank account number and the name of the account holder to which the refund should be transferred.
If the Consumer withdraws from the order, the Consumer must return the unused and undamaged (the product must be in its original packaging) Products without delay, but no later than 14 calendar days from sending the withdrawal statement. The Consumer may return the Products to Trivupel stores or by post to the following address: Trivupel OÜ, Narva, Tallinna mnt 16, 20304. The Consumer bears the cost of returning the Products when withdrawing from the order.
Trivupel will refund the amount paid for the returned Products and the delivery fee to the extent corresponding to the amount paid by the Customer. Trivupel will refund the money no later than 14 calendar days after receiving the withdrawal statement, but not earlier than 3 working days after receiving the returned Products from the Customer.
If the returned Product has been used, Trivupel reserves the right to demand compensation for damages up to the amount of the Product's sales price, depending on the reduction in the Product's value. This amount will be deducted from the refund amount to the Customer.
Processing of Personal Data
By entering data in the online store and confirming the order, the Consumer grants permission to collect and process the Consumer's personal data (name, personal identification code, contact phone number, delivery and/or home address, email address) and to transfer personal data to logistics partners for product delivery.
The online store has the right to use the Consumer's residential or location address to send advertising and other information to the Consumer.
The Consumer has the right to prohibit the collection and use of their personal data at any time, except when it is necessary to enforce a claim arising from the contract or to deliver the product.
The use of electronic personal data for direct mail is only permitted if the Consumer has given separate consent.
Encrypted data communication with banks during payments ensures the security of the Consumer's personal bank credentials, which are not accessible to the online store.
CUSTOMER RIGHTS
The Customer has the right to order Products in the online store at the prices set by Trivupel and under the fixed conditions.
The Product delivered to the Customer must be accurate and complete and comply with the conditions set by Trivupel.
The Customer has the right to submit claims regarding the order or the Product itself to Trivupel at the address Narva, Tallinna mnt 16, or by email to trivupel@gmail.com within 14 calendar days of receiving the Product.
The Customer has the right to withdraw from the Product order as outlined in the section “Consumer’s Right to Withdraw from the Order.”
The Customer has the right to invoke the legal remedies provided by law in case of non-compliance of the Product with the contract terms.
CUSTOMER OBLIGATIONS
When placing an order, the Customer is required to provide the necessary information for order fulfillment: first and last name, exact address (street, house number, apartment number, postal code, city/village/ or county), contact phone number, and, if possible, email address.
If the Customer and the recipient of the Product are different, the Customer must also provide the information outlined in the previous point for the recipient.
If the information provided by the Customer is incorrect and/or incomplete, Trivupel does not guarantee proper fulfillment of the Product order. If possible, Trivupel will contact the Customer to clarify incorrect or incomplete information.
By placing an order, the Customer confirms that they agree with the terms set forth in these general ordering terms and agrees to comply with them.
TRIVUPELs' RIGHTS
Trivupel reserves the right to change these ordering terms without prior notice by publishing the new applicable terms online.
Trivupel reserves the right to change the prices in the online store without prior notice by publishing the new price list online.
Trivupel reserves the right to refuse acceptance of an order or refuse to fulfill an order, for example, but not limited to, in cases where an incorrect price has been mistakenly published in the price list.
Trivupel does not guarantee that the short description of the Product will match the Customer's opinion of the Product's content.
If the Customer fails to fulfill the obligations imposed on them by these general ordering terms, Trivupel does not guarantee the order’s effectiveness and/or the proper delivery of the Product.
If the Customer fails to fulfill their payment obligation correctly, Trivupel reserves the right to disclose the Customer's data to the payment default register.
TRIVUPELs' OBLIGATIONS
Trivupel is obligated to deliver accurate and complete Products to the Customer.
Trivupel is obligated to accept and document all Customer complaints.
Trivupel is obligated to resolve the Customer’s complaint within 7 working days if the reasons for the complaint are independent of the Customer. If the complaint is caused by the Customer, the Customer must resolve it immediately.
Trivupel is obligated to replace defective Product units. Trivupel is only responsible for manufacturing defects and other defects that were present when the Product was handed over to the Customer.
All disputes between the parties will be resolved through negotiations. If an agreement is not reached and the Customer wishes to continue with a complaint, the Customer has the right to turn to the Consumer Protection Board's Consumer Complaints Commission at Rahukohtu 2, Tallinn 10130.
